Rights are Fifth Amendment property — they must be bought, not taken. Thirty basin tribes had no seat in 1922, but the 1908 Winters doctrine dates their reserved rights to reservation creation, making them among the most senior on the river; settled and unsettled together they may total a quarter or more of the flow.

The 1944 treaty guaranteed volume but not quality, and saline drainage pushed delivered water to about 1,500 ppm, prompting Minute 242 (1973) and the Yuma desalting plant. Minute 319 (2012) traded Mexican storage in Lake Mead for shortage-sharing and funded the March 2014 pulse flow of ~105,000 acre-feet, which briefly reached the Gulf.

The Colorado basin covers about 246,000 square miles, yet the river carries roughly a twenty-fifth of the Mississippi's water. Why?
Basin area is a bad proxy for flow when the basin is a desert. The Colorado is best pictured as a snowbank with a very long delivery route — which is why warming, not just reduced snowfall, hits it so hard.
A spectacular snow year like 2023 arrives. Why doesn't it fix the Colorado?
Warming takes its cut before the river forms: sublimation, earlier melt, thirstier soils and plants. Studies estimate roughly 10% flow loss per degree Celsius. One good winter refills a bathtub with a hole still in it.
How did the Colorado carve a mile-deep canyon through the Colorado Plateau?
Like a bandsaw held steady while you push the wood up into it. The tool is the sediment — the river once moved hundreds of thousands of tons a day through the canyon in flood; clean water is a poor chisel. And with too little rain to round the walls off, you get vertical.
What did John Wesley Powell's 1878 'Report on the Lands of the Arid Region' actually argue, and why was it rejected?
Powell told Washington the West's water was nowhere near sufficient for the farms being promised, and it ended his political career. The Colorado's whole twentieth century is what happened after the United States decided he was a pessimist.
Why did the Upper Basin states want a compact at all, given they had the snow?
The Compact was not written to share the river fairly; it was written to stop the clock. The Upper Basin was watching its water be legally taken by a state that merely got there first.
What was the specific drafting error in 1922 that makes the Compact so hard to live with today?
Both halves matter. The sample was a meteorological accident — tree rings show 1906–22 was exceptionally wet. And fixed volumes cannot self-correct: 'half the river, whatever the river is' would have aged gracefully. 7.5 does not care what fell as snow.
